Terms and Conditions

Please read these terms and conditions carefully before using our postal services.

Applicability

These general conditions for the provision of postal services define the terms and conditions for the provision of postal services (hereinafter referred to as "Postal Services" and defined in Article 2.1 below) provided by Moovit Express, a company organized and operating in accordance with Iraqi law, with registered office in Kurdistan, Iraq (hereinafter referred to as the "Company").

The Company offers and provides Postal Services in accordance with the applicable legislation in the field of postal services.

Definitions

For the purposes of these General Conditions, the following definitions shall apply:

  • Address - the physical address of the place of delivery (including delivery to the mailbox, where applicable) of a Postal Item chosen by the Sender or the physical address of the place of return to the Sender;
  • Addressee - the person to whom the Postal Item is addressed;
  • Working days - regular days from Monday to Friday, excluding Saturdays, Sundays and public holidays in Iraq;
  • Postal Service Tariff - the tariff charged by the Company for providing the postal service;
  • Sender - the natural or legal person who initiates the Postal Item and, personally or through a third party, enters it into the Postal Network;
  • Integrator - any natural or legal person acting on a contractual basis as an intermediary between one or more Senders and the Company;
  • Access Points - the physical facilities, including parcel lockers, available to the public, through which Postal Items can be entered into the Postal Network;
  • Postal Item - addressed good in final form in which it is to be carried and delivered to the address indicated by the sender;
  • Website - the Company's website, through which the Company will offer the Postal Services;
  • Mobile App - the official mobile application of the Company for providing Postal Services;
  • Postal Services - services consisting of the collection, sorting, transport and delivery of Postal Items;
  • Postal Network - the system of organization and resources used by the Company for postal operations;
  • Points of Contact - all physical facilities through which Postal Items can be delivered to Recipients;

Postal Services Provided

The company provides the following types of Postal Services:

  • Services consisting of the collection, sorting, transport and delivery of domestic and international postal items weighing up to 2 kg (inclusive)
  • Services consisting of the collection, sorting, transport and delivery of domestic and international parcels
  • Services consisting of the collection, sorting, transport and delivery of domestic and international postal parcels weighing up to 10 kg (inclusive)
  • Services consisting of the delivery of international postal parcels with weight limits between 10 kg and 20 kg (inclusive)
  • Registered mail service for domestic and international postal items
  • Declared Value Mail Service for domestic and international postal items
  • Mail Advertising Services for domestic and international mailings
  • Service against Refunds
  • Destination Change Service
  • Special Delivery Service
  • Acknowledgement Service
  • Express Service

All Postal Services referred to above may be provided directly by the Company and/or by one or more authorised subcontractors of the Company.

Terms and Conditions

The individual contract shall be deemed to have been concluded between the Sender or Integrator and the Company in these General Conditions at the time of acceptance of the Mail Delivery in the Postal Network, without the need to draw up a document.

In the case of the Registered Mail Service, the Declared Value Mail Service, the COD Service, the Change of Destination Service, the Special Delivery Service and the Express Service, the Company will issue, including by electronic means, at the time of acceptance of the Mail Item, a document certifying the service chosen by the Sender or Integrator.

Postal Services are provided by the Company directly and/or through one or more of the Company's authorized subcontractors.

The company provides Postal Services in accordance with the applicable legislation in this field. In the case of international Postal Items, both parties shall additionally comply with the legal provisions applicable in the field of customs, as well as with the legislation of the countries on whose territory the postal services are provided and those transited by the Postal Item.

Conditions for Accepting Postal Items

The Company will accept Postal Items for delivery if the following conditions are met:

  • The Postal Item is properly packaged, in accordance with the content, size, weight, and shape of the item, so that it does not present a danger to the employees handling it or to other Postal Items or property;
  • The Postal Item has the correct and complete address of the Addressee and the Sender, written legibly with Latin characters and Arabic numerals, on the Postal Item or on a label attached to it;
  • The Postal Item does not contain prohibited items, as defined in the applicable legislation and in these General Conditions;
  • The Postal Item is accompanied by all the necessary documents for customs clearance, in the case of international Postal Items;
  • The appropriate tariff has been paid for the Postal Service chosen by the Sender or Integrator;

The Company reserves the right to refuse to accept a Postal Item if it does not meet the conditions set out above or if there are reasonable grounds to believe that the Postal Item may contain prohibited items.

The Sender or Integrator is solely responsible for the accuracy and completeness of the information provided regarding the Postal Item, including the address of the Addressee and the Sender, the contents of the Postal Item, and its value.

The Company may, at its discretion, verify the contents of a Postal Item at the time of acceptance, in the presence of the Sender or Integrator, if there are reasonable grounds to believe that the Postal Item may contain prohibited items or if the verification is required by the applicable legislation.

Quality Conditions

The Company is committed to providing Postal Services in accordance with the following quality standards:

  • Delivery Time: The Company will make reasonable efforts to deliver Postal Items within the timeframes specified for each type of Postal Service. However, these timeframes are indicative and not guaranteed, unless expressly provided otherwise in these General Conditions or in a separate agreement.
  • Handling: The Company will handle all Postal Items with reasonable care and skill, in accordance with industry standards and applicable legislation.
  • Customer Service: The Company will provide customer service through various channels, including telephone, email, and in person at the Company's Access Points, during the working hours displayed at each Access Point or published on the Website.
  • Complaints: The Company will handle complaints regarding Postal Services in accordance with the procedure set out in these General Conditions and in the applicable legislation.
  • Compensation: The Company will provide compensation for loss, theft, or damage to Postal Items, or for failure to provide Postal Services, in accordance with the provisions of these General Conditions and the applicable legislation.

The quality standards set out above are subject to the following limitations:

  • Force majeure events, as defined in the applicable legislation;
  • Compliance with legal obligations imposed by the applicable legislation;
  • Reasonable measures taken to protect the health and safety of the Company's employees or third parties;
  • Acts or omissions of the Sender, Addressee, or any third party not under the control of the Company;
  • The nature or content of the Postal Item, including its fragility, perishability, or sensitivity to external factors such as temperature, humidity, or pressure.

Liability and Responsibility

By using our services, customers acknowledge and agree to the following limitations of liability and responsibility:

  1. Order Responsibility: Customer is responsible for verifying all order details. We cannot accept liability for ordering mistakes.
  2. Government & External Factors: We are not liable for delays or issues due to government changes, taxes, customs, airport closures, or weather conditions.
  3. Collection & Liability: Once items leave our warehouse, customer assumes all risk. Please inspect goods before departure.
  4. Permits & Documentation: Customer must obtain and pay for all required permits, licenses, and customs documentation.
  5. Restricted Items: We do not handle items prohibited by Kurdistan Regional Government or international regulations.
  6. Delays: We are not responsible for delays due to political, economic, or weather-related circumstances beyond our control.
  7. Insurance: We recommend purchasing cargo insurance. Our liability is limited.

Important: These limitations are essential to our service provision and reflect industry standards for logistics services in the Kurdistan region.
